These Terms of Use (“Terms”) govern your one-time purchase, access, and use of a dated snapshot of reports, datasets, data annexes, maps, and supporting files (the “Licensed Deliverables”) provided by After Five Collective Inc. (“After Five”, “we”, “us”).
By completing your order, checking the acceptance box, or submitting payment via our checkout page, the purchasing individual or organisation (“Licensee”, “you”) agrees to be bound by these Terms. These universal Terms and your completed Order Schedule form the agreement. The Order Schedule identifies the specific snapshot and deal and must be provided before acceptance. The same Terms may cover different datasets, geographies, and buyer types. The Order Schedule prevails only where it expressly identifies a provision of these Terms being varied. All other Terms continue to apply. No exception can waive required community consent, community dignity and programme integrity protections, applicable privacy obligations, or mandatory legal rights. A person accepting for an organisation must have authority to bind it.
1.The Purchase & Perpetual Licence
Permanent retention and internal use. Upon full payment, you may keep the purchased snapshot files permanently. After Five grants you a perpetual, non-exclusive, worldwide, non-transferable licence to use them for internal assessment, planning, research, and organisational decision-making, subject to these Terms. Keeping the files does not grant unrestricted rights to publish, promote, redistribute, or reuse community media. The restrictions below continue for as long as the files are retained or used.
Ownership. After Five and its community partners retain all underlying intellectual property rights, database rights, and copyrights. This agreement is a licence of data and analysis, not a sale of underlying proprietary databases or methodologies. It does not transfer ownership or claim exclusive ownership of every underlying fact. Community members, contributors, and third parties retain their applicable rights.
Dated snapshot. Your purchase covers only the files and versions expressly identified in the Order Schedule, representing information available as of the stated snapshot date. It is a one-time purchase, not a subscription or entitlement to the live underlying database.
Evolving source datasets. Our underlying datasets may continue to grow or change after your snapshot is issued. Those changes do not automatically become part of your purchase. After Five may notify you of material errors or privacy, consent, safety, or rights issues affecting the supplied snapshot and provide corrective instructions or replacement files. Required protective corrections do not create an entitlement to general updates.
2.Delivery and Future Purchases
Delivery. The Order Schedule identifies the snapshot date and version, included files, delivery method, and delivery timing. Any download availability period must be stated in the Order Schedule. A download deadline is separate from your perpetual licence to use files already received.
Future editions. New records, later field observations, verifications, expanded geographic coverage, and future editions are not included unless expressly agreed in the Order Schedule. A later snapshot may be purchased separately under its own Order Schedule.
Restoration reporting. Updates about the cleanup initiative remain governed by section 6. They do not constitute updates to the purchased dataset or a data subscription.
3.Permitted & Restricted Uses
Permitted use. Authorised personnel and internal advisers may use the files solely for internal operations, evaluation, reporting, and planning, unless the Order Schedule expressly authorises additional uses and identifies the provisions of section 3 being varied. Broader permissions must define their purpose, scope, recipients, and restrictions. You remain responsible for their use.
Attributed aggregate publishing. You may publish high-level, non-identifying aggregate summaries or findings derived from the Licensed Deliverables, provided you cite:
“Source: After Five Collective Inc. | AlerteUnité ([Dataset/Report Name], [Release Date/Version])”
Attribution does not authorise use of our trademarks or imply our endorsement. Broader publication requires prior written permission.
Strict restrictions. Without our prior written consent, you must not:
- Resell, sublicense, publicly upload, or distribute the raw datasets, spreadsheets, GIS layers, or core files.
- Give access to unauthorised parties.
- Use the materials, raw records, or metadata to train, fine-tune, or benchmark artificial intelligence (AI) or machine learning models.
- Use the Licensed Deliverables to build a competing data product.
- Attempt to de-anonymise or re-identify individuals or sensitive field sources.
- Use the data to target, exploit, or marginalise local communities.
- Remove source and verification notices.
4.Community Media & Consent
Supporting media (field photographs, video interviews, voice recordings, community testimonies) are provided for informational purposes and internal contextual validation only. They are not promotional assets. Permanent possession does not create permission for public display or external reuse.
You must not use the purchased files or derived findings for advertising, fundraising campaigns, promotional materials, or endorsements without a separate written authorisation from After Five defining the proposed use. This includes your own promotion and promotion on behalf of third parties. Permission to publish an attributed informational aggregate finding under section 3 does not permit promotional use.
Community media must not be publicly posted, externally distributed, or used in promotion without After Five’s prior written authorisation and all required individual and media rights holder permissions. Access does not grant permission to use any community member’s image, voice, name, likeness, or testimony in promotion or endorsements.
Such use requires prior, explicit, informed, documented consent from each identifiable community member concerned, covering the proposed purpose, media, and distribution channels. For minors or persons unable to provide legally valid consent, the legally required representative’s consent must also be obtained, together with any other applicable safeguards.
Consent to recording or informational use does not constitute consent to promotional use. Community participation or receipt of support must not be made conditional on promotional consent. Permission from After Five or a community organisation does not replace individual consent where required.
Any authorised external use also requires necessary permissions from the media rights holder. You must respect communicated consent restrictions and promptly address withdrawal requests in accordance with applicable law.
Community dignity and programme integrity. You must not edit, caption, frame, combine, or distribute community media in a misleading, demeaning, discriminatory, sensationalised, or exploitative manner, including taking statements out of context, presenting historical footage as current, implying endorsement, or depicting people or communities as inherently helpless, irresponsible, or inferior. You must not use the materials to stigmatise or humiliate community members or falsely represent the programme, its partners, or its outcomes. These restrictions protect community dignity, trust, and the integrity of the programme and cannot be waived through an Order Schedule.
Accurate, contextual reporting of documented conditions or concerns is not prohibited solely because it is critical or unfavourable. It remains subject to the agreed publication permissions, confidentiality, privacy, and consent requirements. Nothing in these Terms prevents legally required disclosure or lawful reporting to an appropriate regulator.
If an unauthorised or prohibited use occurs, you must promptly stop the use, remove content within your control, request removal from recipients or platforms to which you supplied it, and cooperate with reasonable corrective measures. The obligations in this section continue indefinitely after purchase, delivery, or termination.
5.Cleanup Activation & Fund Accountability
Each purchase activates a cleanup initiative in one community, identified in your Order Schedule or selected through the process described there.
Activation means initiating coordination with the community, confirming the cleanup scope and delivery arrangements, and committing resources toward implementation. It does not mean that a completed cleanup or restoration outcome is guaranteed at the time of purchase.
Your Order Schedule must specify the expected cleanup scope, activation timeline, and how the contribution is allocated. Contributions may support direct implementation costs and necessary coordination, transport, equipment, safety measures, verification, and documentation disclosed in that allocation. We will not represent the full payment as a direct transfer to community members unless that is accurate.
The contribution purchases the Licensed Deliverables and supports the stated initiative. It does not, by itself, constitute a charitable donation, investment, ownership interest, or entitlement to a charitable tax receipt.
Limitations. Because implementation takes place through communities and local partners, we cannot guarantee the success of cleanup or restoration attempts, a particular environmental result, or lasting conditions after work is completed. Delivery may be affected by weather, flooding, security conditions, site access, permissions, waste disposal capacity, transport, equipment availability, funding sufficiency, partner capacity, or subsequent damage. These limitations do not remove our responsibility to exercise reasonable care, use funds for the agreed purpose, document known issues, and communicate material setbacks.
Delays. If the agreed initiative is materially delayed or cannot proceed safely or lawfully, we will notify you, explain the known reasons and status of funds, and propose a revised timeline or alternative cleanup in one community. Any material change to the agreed purpose or community requires your written agreement. If no acceptable alternative is agreed, we will return the unspent cleanup allocation, subject to applicable law. Amounts already reasonably spent or irrevocably committed are accounted for and are not automatically refundable solely because the outcome was unsuccessful.
6.Evidence & Reporting
We will provide a record of activation and reasonable updates on implementation, including available evidence of expenditure, activities, results, and limitations. Reporting frequency and any independent verification included in the purchase must be specified in the Order Schedule.
Evidence may be incomplete, delayed, anonymised, or withheld where disclosure would compromise privacy, consent, safety, or security. We will identify material gaps rather than present unverified information as confirmed.
Funding an activity does not entitle you to claim that restoration succeeded or that an outcome was independently verified. Public impact claims must accurately reflect the available evidence and the contribution’s role.
7.Data Quality & Responsible Reliance
Licensed Deliverables may include community-reported observations, field assessments, estimates, and independently verified records. These categories must not be represented as interchangeable. The snapshot describes information as of its stated date and may include observations collected earlier. Conditions may change after collection. No ongoing monitoring or data updates are included in a snapshot purchase.
We will use reasonable care in preparing and maintaining the Licensed Deliverables, but do not guarantee completeness, uninterrupted access, or the absence of errors. The materials are informational and must not be the sole basis for emergency response, engineering, health, safety, or other high-stakes decisions. Obtain appropriate current information and professional assessment.
You must preserve material caveats and promptly notify us of suspected errors or privacy issues.
8.Privacy & Third-Party Rights
You must protect confidential and personal information, limit access to authorised users, and comply with applicable privacy and data protection laws. Do not disclose sensitive locations or identifiable records without the required authorisation and lawful basis. Notify us promptly of unauthorised access or disclosure and cooperate in mitigation.
Third-party materials may carry separate conditions identified with the materials or in the Order Schedule. We will identify known restrictions and will not include materials in the licensed scope where we lack permission to supply them.
9.Suspension & Termination
We may suspend delivery or download access immediately where reasonably necessary to address a privacy, consent, safety, or security issue. For other material breaches, we will provide notice and a reasonable opportunity to remedy where the breach can be remedied.
We may terminate for a material breach that remains unresolved or cannot be remedied (including unauthorised redistribution, AI model training, or commercial resale). Upon termination for cause, your permission to make further use of the materials ends. You may retain the purchased files as a secure inactive archive, but must not analyse, publish, promote, redistribute, or otherwise reuse them. Permanent retention remains subject to legally required deletion and targeted removal of affected material where necessary to address unlawful disclosure, privacy, consent, or third-party rights. Unaffected files may continue to be retained. Restrictions on promotional use, privacy, confidentiality, attribution, and unresolved cleanup funds survive termination. Cleanup fund use, accounting, and reporting obligations continue after delivery or termination until the activity or remaining funds are resolved under sections 5 and 6.
10.Liability
To the extent permitted by applicable law, neither party is liable for indirect or consequential loss arising from this agreement. After Five’s aggregate liability is limited to the amount paid under the affected order.
These limitations do not exclude liability for fraud, wilful misconduct, gross negligence, misuse of restricted cleanup funds, or liability that cannot lawfully be excluded. They do not replace the express obligations concerning fund use, accounting, refunds, and consent.
11.Changes, Governing Law & Contact
Material changes to these Terms require notice and express agreement to apply to an existing purchase or licence. Revised terms may be offered for new purchases.
This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, subject to mandatory laws that apply to the transaction.
